(CNN) — The chief justice [Presidente do Supremo Tribunal] of the Brazilian Supreme Court [Supremo Tribunal] ruled [decidiu] Tuesday in favor of an American father in an international custody [guarda] battle [batalha].
The ruling [decisão] by Chief Justice Gilmar Mendes will reunite a 9-year-old boy with his father, David Goldman, who has been locked in [envolvido] a custody battle with the family of the boy’s deceased [falecida] mother.
David Goldman arrived in Rio de Janeiro to reunite with his son, but one Supreme Court justice [Ministro do Supremo Tribunal] issued a stay [concedeu uma liminar], ordering Sean to remain with his Brazilian relatives [parentes] until the high court could consider the case.
Mendes’ decision lifted the stay [cassou a liminar], paving the way [preparando o terreno] for Goldman to be reunited with his son.
The custody battle began in 2004, when Goldman’s wife, Bruna Bianchi, took their then-4-year-old son from their home [casa; lar] in New Jersey to Rio de Janeiro for what was to have been [para o que era para ter sido] a two-week vacation. She never returned, instead remarrying [casando-se novamente] there and retaining custody of Sean. She died [faleceu] last year in childbirth [parto].
Goldman has argued [argumenta, defende a tese de] that as the sole [único] surviving [vivo] parent [pai ou mãe, progenitor], he should be granted custody [ele deveria ficar com a guarda].
The Bianchi family argue it would traumatize Sean to remove him from what has been his home for five years.
While the chief justice studies the case, Brazilian Attorney General [Advogado-Geral da União] Luis Inacio Adams said the executive branch [o (poder) executivo] sides with [está de acordo com, apoia] Goldman.
“Once [Assim que] we stop cooperating [deixarmos de cooperar] and start breaking our treaties [começarmos a violar nossos tratados] and international obligations, Brazil risks the chance [corre o risco] of not having its own requests [pedidos, solicitações] in the matters [questões] regarding international judicial help granted [concedidos], based on the principle of international reciprocity,” Adams said Monday.
“Not releasing [entregar] the minor [o menor (de idade)] into the custody of his father could bring sanctions against Brazil,” he added. “It could damage [prejudicar, manchar, macular] Brazil’s image before [perante, diante de] the international community.”
The Bianchi family, who have invited [convidou] Goldman to spend [passar] Christmas [Natal] with them, have prepared the necessary paperwork [documentação] to file an appeal [entrar com recurso] immediately if the court finds against them [se a decisão do tribunal lhes for desfavorável].
